Terms of Service
1. Agreement
These Terms of Service ("Terms") govern your access to and use of Played ("Played," "we," "our," or "us"), including the Played iPhone app, related websites, and associated services. By downloading, accessing, or using the service, you agree to these Terms. If you do not agree, do not use Played.
2. Eligibility and Accounts
- You must be at least 13 years old to use Played.
- You must comply with applicable law and these Terms.
- Played accounts are Apple-authenticated. You are responsible for the activity that occurs under your account.
- If you use Played on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. What Played Does
Played is an iPhone app for importing listening history, syncing recent activity from supported services, generating analytics and visualizations, answering Ask queries about your music habits, and supporting optional social features such as Rooms.
We may add, remove, or change features over time. Feature availability may vary by platform, region, subscription status, account state, or third-party service availability.
4. Free and Premium Features
Some features are available for free and some require a premium subscription. Free features currently include uploads/imports, Apple Music and Last.fm linking, a limited set of history and stats ranges, the current period in charts, current and previous month calendar access, limited Ask usage, and limited private-room creation.
Premium features currently include deeper range access, historical chart navigation, full calendar back-navigation, unlimited Ask usage, event management, and expanded private-room creation. Feature lists may evolve over time.
5. Purchases and Billing
Premium subscriptions are purchased through Apple using your App Store account. Apple, not Played, handles billing, renewals, cancellation flows, and refunds under Apple's own terms and policies.
If you purchase a subscription, you are responsible for any applicable taxes, charges, and fees associated with that purchase. We do not control Apple's billing systems.
6. Your Content and Data
You retain ownership of the content and data you provide, including uploaded listening-history files, Ask submissions, ratings, room metadata, queue activity, and other user-generated inputs.
You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, process, transmit, and display that content only as reasonably necessary to operate, secure, improve, and support Played.
You represent that you have the rights needed to upload or provide any content or data you submit to the service.
7. Acceptable Use
You agree not to:
- Use Played for unlawful, harmful, fraudulent, or abusive conduct.
- Harass, threaten, impersonate, or otherwise abuse other users, including in Rooms.
- Upload or transmit malware, malicious code, or harmful content.
- Attempt unauthorized access to any account, network, data, or backend system.
- Interfere with, disrupt, scrape, overload, or degrade the reliability or performance of the service.
- Violate the rights of others, including privacy, publicity, contract, or intellectual-property rights.
- Reverse engineer or attempt to extract source code from the service except where law permits it despite this restriction.
8. Third-Party Services and Content
Played may integrate with or depend on third-party platforms and providers, including Apple, Apple Music, Sign in with Apple, CloudKit, Last.fm, and Supabase. You may also choose to import files exported from third-party services such as Spotify or Apple Music.
Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, content availability, policy changes, outages, or decisions they make about your account.
9. Suspension and Termination
You may stop using Played at any time. We may suspend, limit, or terminate access to the service if we reasonably believe you violated these Terms, created risk for other users or the service, or where suspension is required for legal, security, or operational reasons.
10. Intellectual Property
Played, including our software, design, branding, and original content, is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not grant you ownership of any Played intellectual property.
11. Disclaimers
PLAYED IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PERFECTLY ACCURATE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $50.
13. Indemnification
You agree to indemnify and hold harmless Played and its affiliates, officers, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses arising out of or related to your use of the service, your content, or your violation of these Terms.
14. Changes to the Service or These Terms
We may modify or discontinue parts of the service at any time. We may also update these Terms from time to time. If we do, we will post the updated version here and revise the "Last updated" date above. Your continued use of Played after the updated Terms become effective means you accept them.
15. Governing Law
These Terms are governed by the laws of the United States and the state in which the service operator is based, without regard to conflict-of-law principles, except where applicable law requires otherwise.
