Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of Played ("Played," "we," "our," or "us"), including the Played iPhone app, related websites, and associated services. By downloading, accessing, or using the service, you agree to these Terms. If you do not agree, do not use Played.

When you download Played through the App Store, Apple's App Store terms and license terms may also apply. If these Terms conflict with Apple's required App Store licensing, billing, or subscription-management terms for the app, Apple's terms control for those App Store mechanics.

2. Eligibility and Accounts

  • You must be at least 13 years old to use Played.
  • You must comply with applicable law and these Terms.
  • Played accounts are Apple-authenticated. You are responsible for the activity that occurs under your account.
  • If you use Played on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. What Played Does

Played is an iPhone app for importing listening history, syncing recent activity from Apple Music, generating stats and visualizations, answering Ask queries about your music habits, and supporting related app features.

Apple Music is the only connected listening source currently supported for ongoing sync. You may also import Apple Music CSV exports and Spotify Extended Streaming History JSON files that you choose to upload. Spotify account linking, Spotify real-time sync, and Last.fm linking are not current launch features.

Played is not a music streaming service. It does not provide rights to listen to songs, download music, or access third-party media catalogs except through your own Apple Music access or files you lawfully provide.

We may add, remove, or change features over time. Feature availability may vary by platform, region, subscription status, account state, or third-party service availability.

4. Free and Premium Features

Some features are available for free and some require a premium subscription. Free features currently include Apple Music linking, Apple Music CSV imports, Spotify Extended Streaming History JSON imports, a limited set of history and overview ranges, current-period charts, current and previous month calendar access, limited Ask usage, and limited private-room creation where room features are available.

Premium features currently include deeper range access, historical chart navigation, full calendar back-navigation, unlimited Ask usage, event management, and expanded private-room creation. Feature lists may evolve over time.

5. Purchases and Billing

Premium subscriptions are purchased through Apple using your App Store account. Current premium subscription options may include monthly and yearly plans, and any available plan, price, billing period, trial, or offer will be shown before purchase.

Subscriptions automatically renew until canceled. Apple, not Played, handles billing, renewals, cancellation flows, refunds, payment issues, price-change consent, and subscription management under Apple's own terms and policies. You can manage or cancel subscriptions in your Apple account subscription settings or through the Manage Subscription control in Played settings where available.

If you cancel, your premium access generally continues until the end of the paid period unless Apple reports that the transaction expired, was refunded, was revoked, or is otherwise no longer active. If you purchase a subscription, you are responsible for any applicable taxes, charges, and fees associated with that purchase. We do not control Apple's billing systems.

6. Your Content and Data

You retain ownership of the content and data you provide, including uploaded listening-history files, Ask submissions, ratings, custom events, room metadata, queue activity, suggestions, and other user-generated inputs.

You grant us a limited, non-exclusive, worldwide license to host, store, reproduce, process, transmit, and display that content only as reasonably necessary to operate, secure, improve, and support Played.

You represent that you have the rights needed to upload or provide any content or data you submit to the service.

Do not upload audio files, copyrighted media files, credentials, files you do not have the right to use, malware, or any data that violates another person's rights. Played imports listening-history metadata, not music files.

7. Acceptable Use

You agree not to:

  • Use Played for unlawful, harmful, fraudulent, or abusive conduct.
  • Harass, threaten, impersonate, or otherwise abuse other users, including in Rooms.
  • Upload or transmit malware, malicious code, or harmful content.
  • Upload credentials, secrets, payment-card numbers, government IDs, or other sensitive information that is not needed for Played.
  • Attempt unauthorized access to any account, network, data, or backend system.
  • Interfere with, disrupt, scrape, overload, or degrade the reliability or performance of the service.
  • Violate the rights of others, including privacy, publicity, contract, or intellectual-property rights.
  • Reverse engineer or attempt to extract source code from the service except where law permits it despite this restriction.

8. Third-Party Services and Content

Played may integrate with or depend on third-party platforms and providers, including Apple, Apple Music, Sign in with Apple, CloudKit, and Supabase. Played may also use third-party metadata or artwork providers, such as MusicBrainz-derived lookups and other non-Spotify metadata sources, to resolve track, album, artist, or artwork metadata. You may choose to import Apple Music CSV exports or Spotify Extended Streaming History files.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, content availability, policy changes, outages, or decisions they make about your account.

Played is not affiliated with or endorsed by Apple, Apple Music, Spotify, or Last.fm. Your use of third-party services remains subject to those services' terms. You are responsible for obtaining and importing your data lawfully.

Apple, Apple Music, Spotify, and Last.fm names and marks belong to their respective owners. Played uses those names only to describe supported connection and user-provided file import sources.

9. Suspension and Termination

You may stop using Played at any time. We may suspend, limit, or terminate access to the service if we reasonably believe you violated these Terms, created risk for other users or the service, or where suspension is required for legal, security, or operational reasons.

You can use Delete Account in Settings to clear active Played app data associated with your profile, attempt best-effort local and CloudKit compatibility cleanup, and sign out. We may retain limited account identity, authentication, entitlement, transaction, security, legal, support, and backup records where necessary or permitted by law.

10. Intellectual Property

Played, including our software, design, branding, and original content, is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not grant you ownership of any Played intellectual property.

11. Disclaimers

PLAYED IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PERFECTLY ACCURATE.

Played's stats, charts, Ask results, summaries, and recommendations depend on the data available from Apple Music, uploaded files, imports, sync jobs, and third-party metadata providers. They may be incomplete, delayed, duplicated, filtered, or inaccurate. Played is for personal music-history exploration and is not professional, financial, legal, medical, or other regulated advice.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $50.

13. Indemnification

You agree to indemnify and hold harmless Played and its affiliates, officers, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses arising out of or related to your use of the service, your content, or your violation of these Terms.

14. Changes to the Service or These Terms

We may modify or discontinue parts of the service at any time. We may also update these Terms from time to time. If we do, we will post the updated version here and revise the "Last updated" date above. Your continued use of Played after the updated Terms become effective means you accept them.

15. Governing Law

These Terms are governed by applicable laws of the United States, without regard to conflict-of-law principles, except where the laws where you live provide non-waivable rights or require a different governing law. Nothing in these Terms limits rights you cannot waive under applicable consumer law.
